The first part of the paper introduces the varieties of modern constructive mathematics, concentrating on Bishop's constructive mathematics. it gives a sketch of both Myhill's axiomatic system for BISH and a constructive axiomatic development of the real line R. The second part of the paper focusses on the relation between constructive mathematics and programming, with emphasis on Martin-L6f 's theory of types as a formal system for BISH.

Given his view that the modern world is ‘radically evil’, Adorno is an unlikely contributor to business ethics. Despite this, we argue that his work has a number of provocative implications for the field that warrant wider attention. Adorno regards our social world as damaged, unfree, and false and we draw on this critique to outline why the achievement of good work is so rare in contemporary society, focusing in particular on the ethical demands of roles and the ideological nature (...) of management’s self-understanding. Nevertheless, we show that Adorno’s comments on activities such as art and philosophy mean that it is possible to draw on his work in a way that contributes constructively to the conversation about good and meaningful work within business ethics. This paper attempts to show how Adorno’s thought can illuminate our reflections on the future of work. It does so by situating Adorno’s conception of genuine activity in relation to his negativist critical epistemology and his subtle account of the distinction between true and false needs. What emerges is an understanding of work that can guide our aspirations for the future of work, and one we illustrate via discussions of creative work and care work. These are types of work which (...) cater to persistent human needs, albeit ones that are distorted under present social conditions. Adorno’s thought helps us to understand why this is the case. Despite achieving broad acceptance of the moral case for treating animals fairly, the animal rights movement has reached an impasse concerning legal rights for animals. Zoopolis proposes a new approach to addressing this failure: integrating animal interests into human society via political institutions and practices. Zoopolis’s central theory that humans owe animals citizenship rights in a shared human-animal society, but that acceptance of responsibilities by animals also is required, has merit for the advancement of animal rights discourse. But its anthropocentric (...) approach, which itself exerts power over animals, necessitating suppression and policing of animals’ natural behavior, is problematic. (shrink)

This paper aims to demonstrate the contemporary relevance of Adorno’s thought for business ethicists working in the critical tradition by showing how his critique of modern social life anticipated, and ofers continuing illumination of, recent technological transformations of capitalism. It develops and extrapolates Adorno’s thought regarding three central spheres of modern society, which have seen radical changes in light of recent technological developments: work, in which employee monitoring has become ever more sophisticated and intrusive; leisure consumption, in which the algorithmic (...) developments of the culture industry have paved the way for entertainment products to dominate us; and political discourse, in which social media has exacerbated the anti-democratic tendencies Adorno warned of in the mid-twentieth century. We conclude by presenting, as a rejoinder to these developments, the contours of an Adornian ethics of resistance to the reifcation and dehumanisation of such developments. (shrink)

Naive observers viewed a sequence of colored Mondrian patterns, simulated on a color monitor. Each pattern was presented twice in succession, first under one daylight illuminant with a correlated color temperature of either 16,000 or 4,000 K and then under the other, to test for color constancy. The observers compared the central square of the pattern across illuminants, either rating it for sameness of material appearance or sameness of hue and saturation or judging an objective property—that is, whether its change (...) of color originated from a change in material or only from a change in illumination. Average color constancy indices were high for material appearance ratings and binary judgments of origin and low for hue–saturation ratings. Individuals’ performance varied, but judgments of material and of hue and saturation remained demarcated. Observers seem able to separate phenomenal percepts from their ontological projections of mental appearance onto physical phenomena; thus, even when a chromatic change alters perceived hue and saturation, observers can reliably infer the cause, the constancy of the underlying surface spectral reflectance. Accounts of video game play developed from an ethnomethodological and conversation analytic perspective remain relatively scarce. This study collects together an emerging, if scattered, body of research which focuses on the material, practical “work” of video game players. The study offers an example-driven explication of an EMCA perspective on video game play phenomena. The materials are arranged as a “tactical zoom.” We start very much “outside” the game, beginning with a wide view of how massive-multiplayer online games are played within (...) dedicated gaming spaces; here, we find multiple players, machines, and many different sorts of activities going on. Still remaining somewhat distanced from the play of the game itself, we then take a closer look at the players themselves by examining a notionally simpler setting involving pairs taking part in a football game at a games console. As we draw closer to the technical details of play, we narrow our focus further still to examine a player and spectator situated “at the screen” but jointly analyzing play as the player competes in an online first-person shooter. Finally, we go “inside” the game entirely and look at the conduct of avatars on-screen via screen recordings of a massively multiplayer online game. Having worked through specific examples, we provide an elaboration of a selection of core topics of ethnomethodology and conversation analysis that is used to situate some of the unstated orientations in the presentation of data fragments. In this way, recurrent issues raised in the fragments are shown as coherent, interconnected phenomena. In closing, we suggest caution regarding the way game play phenomena have been analyzed in this study, while remarking on challenges present for the development of further EMCA-oriented research on video game play. Is there a duty to prosecute grave international crimes? Many have thought so, even if they recognize the obligation to be defeasible. However, the theoretical literature frequently leaves the grounds for such a duty inadequately specified, or unsystematically amalgamated, leaving it unclear which considerations should drive and shape processes of criminal accountability. Further, the circumstance leaves calls to end impunity vulnerable to skeptical worries concerning the risks and costs of punishing perpetrators. I argue that a qualified duty to prosecute can (...) be substantiated on the basis of a single class of reasons, though also that standard justifications of international criminal law (as currently conceived) are not up to the task. The account exploits the expressive dimension of punishment, but locates the central good of criminal accountability in its capacity to appropriately enable an agential stance on the part of subjects in transitional circumstances. It can legitimate, in a way to be specified, hope. The approach also displays the cynicism of an anti‐impunity ethos in the absence of a robust commitment to securing basic human rights in transitional circumstances. (shrink)

It has been widely believed since the nineteenth century that modern science provides a serious challenge to religion, but less agreement as to the reason. One main complication is that whenever there has been broad consensus for a scientific theory that challenges traditional religious doctrines, one finds religious believers endorsing the theory or even formulating it. As a result, atheists who argue for the incompatibility of science and religion often go beyond the religious implications of individual scientific theories, arguing that (...) the sciences taken together provide a comprehensive challenge to religious belief. Scientific theories, on this view, can be integrated to form a general vision of humans and our place in nature, one that excludes the existence of supernatural phenomena to which many religious traditions refer. The most common name given to this general vision is the scientific worldview. The purpose of my paper is to argue that the relation of a worldview to science is more complex and ambiguous than this position allows, drawing upon recent work in the history and philosophy of science. While there are other ways to complicate the picture, this paper will focus on differing views that scientists and philosophers have on the proper scope and limits of scientific inquiry. I will identify two different types of science—Baconian and Cartesian—that have different ambitions with respect to scientific theories, and thus different answers about the possibility of a scientific worldview. The paper will conclude by showing how their differing intuitions about scientific inquiry are evident in contemporary debates about reductionism, drawing upon the work of two physicists, Steven Weinberg and John Polkinghorne. History is more complex than this simple schema allows, of course, but these types provide a useful first approximation into the ambiguities of modern science. (shrink)

This paper explores cultural understandings of virtual sexual ageplay in the online world of Second Life. Online sexual ageplay is the virtual simulation of child abuse by consensual adults operating in-world with child computer characters. Second Life is primarily governed by Community Standards which rely on residents to recognise sexual ageplay and report it, which requires an appreciation of how residents view, understand and construct sexual ageplay. The research presented drew on 12 months of resident blog posts referring to sexual (...) ageplay: 263 total, with 91 residents. The analysis of this talk explores the cultural understandings of this banned behaviour and beliefs about the nature of Second Life which underpin residents’ likelihood to report sexual ageplay and so comply with the Community Standards. In considering these issues the paper is able to highlight issues regarding the unique cultural position of abuse against children and key concerns which underpin the reporting behaviour of residents. Key considerations relate to defining online sexual activity and child avatars; the moral status of ‘reporters’, and sexual ageplay as a form of edgeplay; belief in the harmfulness of sexual ageplay and its relationship to real world behaviours. The paper considers the proper method for theorizing about criminal jurisdiction. It challenges a received understanding of how to substantiate the right to punish, and articulates an alternative account of how that theoretical task is properly conducted. The received view says that a special relationship is the ground of a tribunal’s authority to prosecute and, hence, that a normative theory of that authority is faced with identifying a distinctive relation. The alternative account locates prosecutorial standing on an institution’s capacity to (...) address the basic reasons generating criminal liability. This reframes the normative issues at stake, and has the result that various, perhaps quite heterogeneous, considerations can substantiate penal authority. It also eliminates the existence of a special relation as a necessary condition for legitimate criminal accountability. The argument proceeds by offering an analysis and account of universal jurisdiction. Not only does the alternative elegantly perform where the received view struggles, it can accommodate much of what motivates the pursuit of relational ties in existing efforts to vindicate jurisdictional conclusions. Jaakko Nevasto has offered a number of thoughtful criticisms of our attempt to show that Adorno’s work can fruitfully be brought to bear on topics in business ethics. After welcoming his constructive clarifications, we attempt to defuse Nevasto’s main objections and defend our application of Adorno, focusing in particular on the topics of moral epistemology, needs, and the possibility of genuine activity – and thus good work – within capitalist society.

Judicial obligation to enforce the law is typically regarded as both unproblematic and important: unproblematic because there is little reason to doubt that judges have a general, if prima facie, obligation to enforce law, and important because the obligation gives judges significant reason to limit their concern in adjudication to applying the law. I challenge both of these assumptions and argue that norms of political legitimacy, which may be extra-legal, are irretrievably at the basis of responsible judicial reasoning.

How does morality allocate responsibility for what it requires? I am concerned here with one fundamental part of this question, namely, how morality determines responsibility when multiple agents are capable of contributing to or completing a moral task, and special relationships capable of generating duties with respect to the task are non-existent, insufficient as a moral response, or partly indeterminate. On one view, responsibility falls to the agents who can bear it with the least burden. I show why this is (...) initially attractive and mistaken. Instead, I defend an equity-based approach that accommodates the intuitions that both support and trouble the least-cost principle. One upshot is that sometimes we ought prefer a distribution of responsibility that is more expensive and less local than needed to complete the task. I illustrate the practical significance of the argument in terms of the human rights of refugees. (shrink)

Ethical research with children requires a special concern for their well-being as individuals. Researchers are therefore expected to report problems children experience and to refer children for assistance. This article addresses difficulties that can arise as researchers attempt to meet this obligation in research with low-income ethnic minority children. Potential difficulties include both failure to report and overreporting suspected problems. The role of institutional review boards in researchers' reporting and referring behavior is also discussed.

Ronald Dworkin once identified the basic question of jurisprudence as: ‘What, in general, is a good reason for a decision by a court of law?’ I argue that, over the course of his career, Dworkin gave an essentially sound answer to this question. In fact, he gave a correct answer to a broader question: ‘What is a good reason for a legal decision, generally?’ For judges, officials of executive and administrative agencies, lawyers, non-governmental organizations, and ordinary subjects acting in the (...) variety of legal contexts, Dworkin identified the proper basis for a legal decision, and its implications for the form of well-conducted legal reasoning. Dworkin's stance on the above questions can be characterised by two theses. I defend his view by substantiating each. The result is agnostic about the viability of other aspects of Dworkin's legal theory, as it focuses on the grounds of proper legal decision-making. This increasingly popular discourse on “aesthetic rhetoric,” however, is characterized by a remarkable diversity. The rhetoric of fiction, poetry, and other literary genres, for example, has been explored in these terms (e.g., Booth 1983), as has the rhetoric of film (Haskins 2003), photography (Hariman and Lucaites 2007), and even natural landscapes (Clark 2004). This article examines gender discrimination in earnings and promotions in a sample of 451 computer professionals employed by 14 organizations in a western Canadian city. The data suggest that women computer professionals do less well than their male counterparts in terms of income and job status; the differences are largely attributable to differences in work experience. Strength apparently does not lie in numbers, however. Organizations that hire relatively more women computer professionals seem to choose those who are less well educated (...) and less experienced than their male employees; they reward them correspondingly less well. The authors argue that the different proportions of women are the result of predictable strategies of recruitment aimed at limiting women's access to positions of authority. (shrink)

There is currently unprecedented attention in Australia on the misidentification of women victim-survivors as family violence ‘predominant aggressors’—this focus has largely been oriented towards the role of the police. Less research has considered court responses to misidentification and specifically, the role that legal practitioners play in recognising and responding to clients who have been misidentified. This article addresses this key gap in the literature through an exploration of 18 legal practitioners’ experiences of representing misidentified clients in the civil protection order (...) system in the Australian state of Victoria. The findings suggest that legal practitioners face a number of challenges when representing clients who have been misidentified and that the magistrates’ courts are ill-equipped to respond to misidentification. As a consequence, a culture of respondents consenting to orders that should never have been made against them is maintained. This article calls for a greater focus on the role that the courts can play in providing a ‘safety net’ for victim-survivors who have been misidentified. (shrink)

The bitterness and protracted character of the biometrician–Mendelian debate has long aroused the interest of historians of biology. In this paper, we focus on another and much less discussed facet of the controversy: competing interpretations of the inheritance of mental defect. Today, the views of the early Mendelians, such as Charles B. Davenport and Henry H. Goddard, are universally seen to be mistaken. Some historians assume that the Mendelians' errors were exposed by advances in the science of genetics. Others believe (...) that their mistakes could have been identified by contemporaries. Neither interpretation takes account of the fact that the lapses for which the Mendelian eugenicists are now notorious were, in fact, mostly identified at the time by the biometricians David Heron and Karl Pearson. In this paper we ask why their objections had so little impact. We think the answer illustrates an important general point about the social prerequisites for effective scientific critique. (shrink)

This paper argues that probability is not an objective phenomenon that can be identified with either the configurational properties of sequences, or the dynamic properties of sources that generate sequences. Instead, it is proposed that probability is a function of subjective as well as objective conditions. This is explained by formulating a nation of probability that is a modification of Laplace‘s classical enunciation. This definition is then used to explain why probability is strongly associated with disordered sequences, and is also (...) used to throw light on a number of problems in probability theory. Color vision provides accurate measures of the phase and intensity of daylight, and also a means of discriminating between objects. Neither property implies that objects are colored.

This article considers and criticizes criminal law‘s assumption of the moral autonomy of individuals, showing how that view rests on questionable and obscure Kantian commitments about the self, and proposes a naturalistic alternative developed through a synthetic reading of Adorno‘s and Bhaskar‘s account of the subject in relation to nature and society. As an embodied, emergent, changing subject whose practically rational powers are emergent, polymorphous, and contingent, the subject‘s moral autonomy is dependent on the conditions for experiences of solidarity in (...) four-planar nature. This view makes criminal theory‘s Autonomy Assumption look deeply questionable; autonomy must be a complex, nuanced open question, not an abstract, a priori default assumption. (shrink)

Scatological shock-merchants, untrained social workers, conflict-zone tourists: from a certain standpoint the relationship between contemporary art and ethics involves a string of negative conjunctions. At their center stands the artist, whose personality and intentions often serve as an ethical measure of the work. This book operates on the basis of a different premise: that artworks themselves have ethical effects, and looking at these effects can tell us about wider processes of social change. As the first full-length study of its kind (...) to outline a positive vision of the ethics of contemporary art, this book distances itself from previous accounts that focus on transgression. The critique of transgressive art is not made on the basis that it is wrong, but that it no longer succeeds on its own terms in societies where language, prohibition and morality are more plastic than they once were. By drawing on the work of Félix Guattari and Jacques Lacan, the book develops a novel theoretical framework that emphasizes the effect of art on subjectivity. Along the way artworks by Kader Attia, Artur Zmijewski, Dora Garcia and others serve as springboards launching discussions of the varied pathways along which a renewed ethics of contemporary art might develop. Debates about methodology have been central to the emergence of the “field of science of religion”. Two questions that have motivated scholars in that field over the past half century: “is it theoretically justifiable to bring scientific and religious beliefs into dialogue?” and “can theology be rational in the same way as science?” This article responds to commentary on Against Methodology: Recent Debates on Rationality and Theology, a book which critically examines three major methodologists of recent years: Nancey Murphy, Alister (...) McGrath, and Wentzel van Huyssteen. Themes raised in the commentary include the status of realism and truth in science, the unity of science, the adequacy of the term “critical realism”, proper ways of seeking legitimacy for an academic discipline, and new directions for the field of science and religion. Benjamin Franklin exhorted his fellows to “either write something worth reading or do something worth writing.” John Stuart Mill is among that rare breed who managed to do both. He was a public intellectual before the term was created; an advocate for a humanist, self‐reflective life, but also a man of political action. Mill's thought and life do not stand apart from each other. He was in fact an intensely autobiographical thinker. Mill's extraordinary upbringing and education, for example, fuelled his (...) journey away from utilitarianism towards liberalism. His deep relationship with Harriet Taylor also strongly influenced his thinking on gender equality, social custom and other issues. Mill's life is interesting in itself. The 18th-century Scottish ‘common sense’ philosopher Thomas Reid argued that perception can be distinguished on several dimensions from other categories of experience, such as sensation, illusion, hallucination, mental images, and what he called ‘fancy.’ We extend his approach to eleven mental categories, and discuss how these distinctions, often ignored in the empirical literature, bear on current research. We also score each category on five properties (ones abstracted from Reid) to form a 5 × 11 matrix, and thus can generate statistical (...) measures of their mutual dependencies, a procedure that may have general interest as illustrating what we can call ‘computational philosophy.’. Heidegger's Polemos: From Being to Politics. New Haven: Yale University Press, 2000. Pp. xvi + 302. Cloth, $35.00. That an outstanding philosopher could align himself with a monstrous ideology has always been a scandalous puzzle: but since Farias's Heidegger and Nazism (1989), it is impossible to dismiss Heidegger's "political episode" as the reprehensible but (...) forgivable lapse of a backwoods academic without political sense. Learning that Heidegger not only was a dedicated Nazi, but engineered a postwar cover-up of his involvement, was for many Heideggereans like entering a beloved office and finding swastikas spraypainted over everything. Consternation has hardly died down in the years since. Philosophers have struggled either to repudiate Heidegger's thought entirely or argue that the parts of it he pledged to Nazism were inconsistent with the rest. It isn't that such people deny (or not out loud) what would seem to be an obvious fact: that a bad man can be a good philosopher. They fear that something in Heidegger's thinking somehow "entails" fascism. A dilemma gets set up: either Heidegger's philosophy is contaminated by his actions, or to engage in those actions, Heidegger must have ignored his philosophy.Fried's book on polemos in Heidegger navigates between these horns: on the one hand, Fried dismisses as "absurd" any simple claim that Heidegger's work entails fascism (5), but on the other hand, he attempts to trace, throughout Heidegger's "middle period" (roughly Being and Time to the end of World War II), a notion he believes is consistent with embracing Nazism, not to argue that Heidegger's political decisions were correct or unavoidable, but that they were predictable—though fatally hubristic—responses to the European situation as Heidegger saw it. More, Fried wants to endorse Heidegger's understanding of polemos as valuable for politics today, not because it is insulated against fascism but because fascism is still a possibility we need to confront, even while we attempt to preserve Enlightenment ideals and liberal-democratic institutions in a "nihilistic" world.Heidegger bases his views about polemos ("struggle," "confrontation") on Heraclitus Fragment 53, where it is called "father and king of all." As he explores Heidegger's [End Page 453] treatment, Fried stresses that "what is of interest is not whether Heidegger's interpretations are philologically correct, but rather how these readings shed light on his own way of making sense of history and of politics" (29). And "confrontation" is the closest thing to a consistent political doctrine in Heidegger. He understands it as a respectful opposition that allows each "side" to appear in all its validity and therefore potential risk to the other "side." Confrontation is a principle of interpretation, dialogue between individuals, and interaction between nations (see 79-80). Fried insists that this idea is a crucial part of a number of central Heideggerean concepts, as well as how Heidegger viewed his own task, and Germany's, when National Socialism appeared with its promise of a new spiritual mission for the German Volk. That Heidegger's "romantic" hopes in Nazism were unfounded does not diminish the usefulness of his work on polemos, Fried thinks, because "postmodernist" thinkers, molded by Heidegger, have nothing better to offer as they "confront" the dying or dead "modern" world with dreams of a new society. Some respect for "liberal" values will still be necessary if postmodernist "deconstruction" of oppressive structures is not to leave inroads for new, opportunistic forms of fascism.Fried's is an important study, by a sympathetic but undazzled scholar of Heidegger, of a concept that may be as basic and fruitful as he claims: but his insistence on making everything in "middle Heidegger" depend on it causes him in many places to conflate separate projects and periods in Heidegger's work that were better left distinct. Indeed, believing in the importance of this sort of work, we have each spent much of our careers studying the women writers (...) absent from our own graduate-school education. What follows, however, is a cautionary tale about discovery and reclamation: first, our discovery of what we thought was a hitherto-neglected text by eminent seventeenth-century writer Madeleine de Scudéry—her Lettres amoureuses de divers auteurs de ce temps (1641); second, our discovery that the text was not (even as indexed in Gerritsen Collection of Women’s History microfilm collection) authored by Scudéry but was written instead by a Franciscan priest, Jacques Du Bosc. Clearly, our second discovery pointed out both our own rush to judgment as well as that of other literary scholars interested in the tenuous project of historical reclamation. In this essay, we seek to explore the implications of attribution and authorship for our cautionary tale. Does the fact that a work is not Scudéry’s Lettres amoureuses but instead Du Bosc’s Nouveau recueil de lettres des dames de ce temps (1635) diminish its importance to the history of women’s letters?The First DiscoveryWe became interested in Scudéry’s Lettres amoureuses because of a brief description of the text in Joan DeJean’s Tender Geographies, a pioneering study of women novelists of the seventeenth century. DeJean describes a one-volume work that constituted the first publication of one of the most important writers of the seventeenth century, Madeleine de Scudéry. This work was a reversal of and “forceful response to” the so-called Ovidian model of epistolary fiction in which a “seduced and abandoned” woman complains in letter form about the infidelity of her male lover. In Scudéry’s text, however, men wrote long letters complaining about the women who did not reciprocate their love (DeJean, Tender Geographies 79).We obtained a copy of the Lettres amoureuses from the Women’s History microfilm collection, which was created in the 1970s (published 1983) in order to make available [End Page 1] an extensive array of texts and documents relating to women’s lives. We were surprised to see that all of the letters in the Lettres amoureuses were written by women—not men. Moreover, most of the letters were written by women to other women. No letters by men were included at all. Our copy of Lettres amoureuses contained letters and responses written between women, meant to show the excellence of women’s writing skill. The letters discussed and debated a wide variety of topics of interest to seventeenth-century French women; more strikingly, however, they reflected a close-knit homosocial world of women who openly expressed love, devotion, desire, and longing for each other’s company.Given the differences between our copy of Lettres amoureuses and the text described by DeJean, we wondered if we were looking at the same book. Was our collection the one to which DeJean referred? Yes and no. In another DeJean article about the Lettres amoureuses, we discovered that DeJean had used a particular copy of the text, one found in the holdings of Harvard’s Houghton Library. Upon first obtaining a microfilm copy of the Houghton volume, and later examining the physical book itself in Houghton’s rare books room, we saw that it (unlike our own copy) did indeed contain only letters by men who complain about their female beloveds.
